The Pleasure Craft Licensing program improves public safety and security by giving search and rescue and law enforcement agencies 24 hour, seven-day a week access to the licence information they need in emergency situations. Did you know that any pleasure craft powered by a motor of 10 hp (7.5 kW) or more must have a valid licence? A pleasure craft licence allows search and rescue personnel and other agencies to quickly identify your boat in the event of an emergency.
Transport Canada's Office of Boating Safety has developed an easy to use Pleasure Craft Licence application kit. You can get them:

online at the Office of Boating Safety Web site;
at any Service Canada Centre; and
through regional Office of Boating Safety Centres.

Boaters buying used pleasure crafts now have 90 days to transfer the licence into their name. They may continue to operate their "new" boat during this period with the existing licence on board.

Boat Dealer Online Application Program

During the 2010 boating season, Transport Canada launched the Pleasure Craft Licence Online Application program. This program allows boat dealers to issue new licence numbers on the spot. Boat dealers interested in getting set up for the Pleasure Craft Licence Online Application should visit the Office of Boating Safety Web site to learn how they can become part of the program.

Persons authorized to import automotive vehicles in our country are the ones

listed in

Decree No. 40, RULES ON IMPORTS OF AUTOMOTIVE VEHICLES

NOT INCLUDED IN STATE PLANS AND PASS OF PROPERTY, from

February 22, 1979.

As light vehicles are considered those up two tons weight ,including cars,

jeeps, trucks, pick ups and motor cycles which import is developed out of the

state plans and in a definitive manner.

Who are the ones authorized for this import?

Persons Entity that authorizes the import

a) Branches of Foreign Mercantile Societies,

Travel Agencies, Bank and Financial

Representations and their representatives.

Chamber of Commerce of the

Republic of Cuba

b) Foreign specialists working in Cuba in virtue

of contracts and covenants with national entities

and organisms.

Ministry of Foreign Trade

c) Entities or organizations both, with national

and foreign composition, supported by

Covenants of Economic Cooperation, scientific

and technologic agreements with international

agencies, given that they use the vehicles to

fulfill tasks that originated the Contract.

d) Foreign Press Agencies and foreign

journalists

e)Organizations with social, political or scientific

Non-compliance with the legal provisions of customs regulations shall result in the application

of corresponding administrative measures

The persons who enter Cuba as tourists can temporarily import a vehicle

under the terms and conditions that follow (this information appears in

the link referring to TOURISTS)

Clearance Customs authorizes the regime for up to thirty (30) days, considering

the visa time.

The authorization shall be granted immediately, after the tourist submits: the

visa, the passport and all documents related to the vehicle with the Bill of

Landing or the Air Way Bill, in correspondence with the case.

The tourist is obliged to re export the vehicle in the period of time granted and

always before or in the moment when leaving the country.

TOURISTS, ARRIVING IN THE COUNTRY ON BOARD OF RECREATION

BOATS THROUGH TOURISM MARINAS:

Customs offices authorize the temporary import of a vehicle by a period that

can not exceed 6 months.

The vehicle must be carried on board of the vessel.

The tourist is obliged to re export the vehicle when the term matures (6

months). If in maturity the vessel is still in the Marina, the vehicle is to be kept

on board and so is considered re exported.

If the tourist goes overseas on board of the boat, the vehicle has to be re

exported in all circumstances.

OTHER PASSENGERS CATEGORIES

Automotive vehicles import is not accepted by any other individual not

mentioned in the previous item.

It is not accepted the import of automotive vehicles’ engines and cars

body shells or any motorcycles frames, with any capacity, by individuals

or by any other mean.

The origin of the car is not important. Its good to understand the Cuban situation, Cuba has a severe energy and cash crisis.
To reduce the energy consumption the car ownership is regulated, you have to apply for a license, and the license can be refused. It takes a lot of red tape and patience, but it can be done.
Notice when you import your car permanently you have to pay (high)customs duties in Cuba.

Here are steps how to fix errors in Quickbooks data file.

Usually I get a message on Quickbooks when I want to VERIFY the data file: WARNING
A data problem prevents Quickbooks from countinuing.

Solution :
Rebuild your data now.
...
and it never works until you work on this. Here is how:

go to C:/program files/Intuit/QuickBooks/

find file : QBWIN.LOG

open it with notepad
scroll to the bottom until you will see something like that :

Chrysler is potentially in hot water after advertising the Chrysler 300 as "imported from Detroit". The vehicle is assembled in Canada. A complaint has been filed with the United States Federal Trade Commission alleging misleading advertising.

An American consumer lobby group is taking Chrysler to task over advertisements depicting the Chrysler 300 as “Imported from Detroit.” The luxury sedan is assembled in Brampton, Ont.
In a complaint filed to the United States Federal Trade Commission on Monday, the non-profit Made in USA Foundation argues that “Chrysler’s false advertising is likely to cause substantial injury to consumers who seek to buy U.S.-made vehicles.”
“I don’t think Detroit’s in Canada the last time I checked,” said Joel Joseph, chair of the California-based foundation.
Chrysler’s “Imported from Detroit” campaign started in February with a two-minute Super Bowl ad featuring Detroit-born rapper Eminem driving through the city in a Chrysler 200, which is assembled in Detroit. “When it comes to luxury, it’s as much about where it’s from, as who it’s for,” says a deep-voiced narrator.
The campaign hit the Made in USA Foundation’s radar in May when Chrysler extended the “Imported from Detroit” moniker to the Chrysler 300. Detroit Lions’ defensive tackle Ndamukong Suh and fashion designer John Varvatos are similarly depicted cruising gritty American streetscapes in the Ontario-made vehicles. Often, the cars are powered by Mexican-made engines. “The ads are clever, but they are false,” writes Mr. Joseph in a prepared release.
The Chrysler Town and Country minivan, which is assembled in Windsor, Ont., has similarly appeared in ads sporting the Imported from Detroit slogan.
“‘Imported from Detroit’ is sort of a fanciful reference, it was never intended as a literal reference,” said Chrysler spokesman Michael Palese. “It’s more of an image and marketing type program.”
The company has played with geography in its ads before. In a 1974 Chrysler ad campaign featuring actor Ricardo Montalbán, the company boasted of upholstering its cars with “soft Corinthian leather.” Rather than coming from the Greek municipality of Corinth, however, the leather came from New Jersey.
The Made in USA Foundation’s petition comes just as U.S. president Barack Obama is touting a $447 billion jobs plan replete with a “Buy American” clause that would prohibit the use of foreign-made manufactured goods in public works projects.
As U.S. auto commentators are quick to note, however, the nationality of a modern car is notoriously hard to trace. “American” cars like the Ford Fusion and the Buick Regal are made in Mexico and Germany, respectively. The Japanese-manufactured Toyota Camry, Sienna and Tundra meanwhile, are comprised of 80% U.S. parts.
On Monday, the Made in USA foundation also filed a complaint against Ford for a radio ad in which the Oakville, Ont.-built Ford Edge is referred to as an “American car.” Ford spokesman Said Deep said the ad was released by a dealer outside of Ford’s normal marketing channels. Nevertheless, he noted that “100% of the engineering, development and testing of Ford vehicles is done in the United States.”
Ironically, the Made in USA Foundation was created in 1989 by a partial grant from the Ford Motor Company.
Lately, Ford, along with Chrysler and General Motors have been repeatedly accused of illegally removing country-of-origin stickers at auto shows, a violation of the American Automobile Labeling Act. “General Motors wants to hide the fact that, even after the government bailout, it has moved production of vehicles offshore,” wrote Mr. Joseph in January.
Chrysler calls the allegations “completely without merit.” “Neither the [American Automobile Labeling Act] nor the regulations respecting it contain any provision that requires labeling on vehicles that are on display at auto shows,” wrote Mr. Palese in an email to the Post.

GM Agrees to Pay $20 Million to Settle Vehicle Export Lawsuit

General Motors of Canada, Ltd. has agreed to settle the ongoing antitrust lawsuit in the United States.
The lawsuit alleges that vehicle manufacturers violated antitrust laws by conspiring with each other
to prevent the export of vehicles from Canada to the United States when the Canadian dollar
was trading at low values.
Last week the California Superior Court approved a prelimary settlement in which GM
will pay $20.15 million. Toyota previously settled for $35 million.

Cuba gives green light to buying, selling cars

For the first time since the 1959 revolution, Cuba has given its citizens the green light to buy and sell cars in one of most eagerly awaited changes under President Raul Castro.
An official decree published on Wednesday said Cubans and foreign residents would now be able to do with their cars what they wanted “without any prior authorization from any entity.”

But the regulations, which take effect on Saturday, will only allow Cubans with government permission and foreign residents to import cars, while all others will be limited to vehicles already on the island.
The liberalizing of car sales was one of more than 300 changes approved in April at a congress of the Communist Party, Cuba’s only legal political party.
They allow for Cubans migrating from the island to sell their cars or to give them to family members, neither of which they could do before.
Foreign residents temporarily living on the island will be limited to buying two cars, imported or not, during their stay.
Previously, only automobiles that were in Cuba before the 1959 revolution could be freely bought and sold, which is why there are so many 1950s or earlier cars, most of them U.S.-made, rumbling through Cuban streets.
There are also many Soviet-made cars, dating from the era when the Soviet Union was the island’s biggest ally and benefactor.
They have been available for those with government permission, including assorted officials, athletes, artists and doctors returning from service overseas.
The regulations have been long promised by the government and eagerly anticipated by Cubans.
The changes are part of Mr. Castro’s wide-ranging economic program which has been slow in developing, but he says is necessary to ensure the survival of Cuban communism.
“It’s great because it was something forbidden and prices were really high, and if you had a car you weren’t able to do anything with it,” said office worker Silvia Santos.
“It’s a way of freeing something,” she said.
One difficulty facing many Cubans, who make an average monthly salary equivalent to about $20, will be rounding up the money to buy a car.
“Maybe if I can save money one day in my life I will be able to buy as car,” Ms. Santos said. “It’s going to be hard, but at least now it’s a possibility.”

Why shopping for your next car may require a trip farther south than "Down South"

Haven't seen the orange VW before? The CrossFox is an off-road version of Volkswagen's Fox supermini, and would be perfect for Canadian roads.

Just before Canadian Parliament dissolved in late March, to clear the way for the Federal Election, it passed Bill S-5, to very little fanfare.

But maybe we should have been done the Mexican Hat Dance.

Because Bill S-5 will (eventually) clear the way for Canadians to not only purchase late-model used vehicles from Mexico — something we always could do— but to actually license and register and drive them in our respective provinces — something we could never do.

So how about an Audi A1, or Ford Ka, or the Toyota Hilux diesel pickup truck?

Not so fast, enchilada breath…

Here’s the deal… It will take another year or two for the government to work out the regulations and protocols for Mexican used-vehicle importation, and the only vehicles allowed in will be those that can be certified for Canadian safety and environmental standards. This means that some vehicles will continue to be effectively persona non grata in Canada, because if they don’t already meet Canadian safety and environmental standards, it will likely be too costly and difficult to make them so.

But as is the case with American market vehicles, there will no doubt be a lot of vehicles that already meet Canadian safety and environmental standards; the only modifications they need then for Canadian certification are relatively affordable and straightforward ones, such as daytime running lights, metric gauges, and Canadian compliant child seat latching systems.

(At some point, Transport Canada will certainly publish a list of Mexican market vehicles, which fit the above criteria.)

NAFTA Compliance Issue

Why did Canada suddenly get the impulse to invite Mexican used vehicles to our party? In order to bring Canada into compliance with the automotive provisions of the North American Free Trade Agreement (NAFTA).

Those provisions require that Mexico, the United Sates and Canada allow the importation of used vehicles from one another’s countries. All the parties were supposed to have this provision done by the end of 2010. Canada was the lone laggard; hence the rush to get it done before the election.

Canada and Mexico will follow a phased implementation: Allowable importations start with vehicles 10 years old and older. The age threshold for the vehicles will decrease by two years, every two years, until 2019, when all the NAFTA countries may not adopt or maintain any prohibition or restriction of used vehicles from each other.

U.S. Vehicles Pave Way

Vehicles imported for use in Canada that are 15 years old or older are not required to meet our safety or environmental standards — regardless of which country they originate from.

So this new Mexican move is about late model used vehicles (14 years and younger), and will (eventually) make Mexico equivalent to the U.S., when it comes to used vehicle importation into Canada. We’ve been able to import late-model used vehicles from the U.S. since 1995, due to provisions in the original Canada-U.S. Free Trade Agreement of the late 1980s.

And by the way, before the Mexican move, the United States was the only country in the world allowed to ship its late-model used vehicles into Canada.

To monitor and regulate the importation of American used vehicles into Canada, the government set up, in 1995, the Registrar of Imported Vehicles (www.riv.ca). This registrar program will be extended to cover Mexican vehicles.

The sold-in-Mexico Peugeot RCZ, a "French-ified" Audi TT Coupe, is one of the most beautiful cars on sale at any price.

How many Mexican vehicles?

“There won't be a rush of people of people at the border, waiting to take their cars across,” predicts Brian Osler, president of the North American Automobile Trade Association (NAATA). His member companies are those that buy and sell vehicles across international borders.

He suggests a slow build up, because that’s what happened when Canada first allowed U.S. imports.

“It took a long time for people to become aware that there was one more buying channel… It takes your nieghbour buying one, takes seeing it in the press. It won’t happen overnight.”

In 1995, just over 13,000 used vehicles were imported into Canada. In 2010, over 150,000 made the journey.

Considering the millions of used vehicles currently on our roads, the American used import portion would certainly have to be classified as a “niche.” But it’s a big niche and on track to one day outgrow the term.

“It is not insignificant any more,” notes Osler. “All the industry players, be they manufacturers, leasing companies, dealers, etc., have all adjusted their buying and selling practices to allow for used vehicle imports.”

Because of all this future potential, Osler was actually “shocked” about how little press coverage and general discussion there was, when Canadian MPs did the deed back in March, and officially opened the door to Mexico’s used vehicles.

“All of sudden you open up this whole new market and no one is talking about it.”

Future Predictions

Osler expects growth, but not at the level so far seen with American imports, due to the added comfort and better logistics offered by the American market.

“I expect dealers to buy from Mexico long before consumers,” adds Osler. “Some of our member dealers are already busy developing contacts in Mexico. Dealers are more accustomed to treating the automobile as a commodity.”

But no one can predict the future with absolute certainty, and in future years the relative currency values and the relative used vehicle prices in each country may set the tone as to how fast, or how slow, is the flow of used vehicles from Mexico.

Currently the conditions must be at least favourable — many NAATA dealers already purchase Mexican used vehicles for export into European markets.

Future Funkiness?

At the very least, the move will eventually establish protocols and an infrastructure to import a lot of interesting models that were heretofore unseen in Canada. If they were 15 years old or older, they could have arrived before now — but now it will be easier and more likely to happen. We may even see dealers who specialize in the funkiness. If so, in a few years I might even put an order in for, say, a decent Peugeot RCZ.

Registering your business
As a commercial importer, you must have a Business Number for your import/export account.

The Business Number (BN)

The business number (BN) has 15 digits: nine numbers to identify the business, plus two letters and four numbers to identify the program and each account. The system includes major types of Canada Revenue Agency and Canada Border Services Agency programs that many businesses may be registered for:

GST;
payroll deductions;
corporate income tax; and
import/export (identified by RM ).

For example, your import/export account will look like this:

You only use your import/export account for importing or exporting. If you do not use it, your account will expire after two years. You can reactivate it by contacting any customs office. If there is any change in your status (e.g., name or address change), you must report these changes to us as soon as possible.

Here are instructions that I found here...and they worked on my 02 limited.

1. unlock all of the doors in the car, open the driver's side door, and make sure the key is not in the ignition
2. put the key into the ignition and then pull it out without turning it or anything
3. within 40 seconds, lock and then unlock the doors five times using the power lock button on the driver's side door.
4. close the door and then open it again
5. within 40 seconds lock and then unlock the doors five times again using the power lock button.
6. Put the key into the ignition and turn it to the on position (not acc and not far enough to actually start the engine) and then back to the off position, then back to on and back to off.
7. Pull the key out of the ignition
8. If you are successful, after about 5 seconds, the doors should power lock and then unlock on their own. If that doesn't happen then try again from step 1.
9. within 40 seconds, hold down the lock and unlock button simultaneously on the remote for a second. Then release and hold down the lock button for 3 seconds. The power locks should cycle again once on their own. If they don't cycle exactly once, repeat this step from the beginning with the remote again.
10. Repeat step 9 for every remote you want to program. You have to do this with any remotes that were previously programmed because this process essentially resets what remotes the car will respond to.
11. Close the driver's side door to signify that you are done programming the remotes.

SUMMARY

:

This document amends

NHTSA’s regulations pertaining to

registered importers (‘‘RIs’’) of motor

vehicles not originally manufactured to

comply with all applicable Federal

motor vehicle safety. The agency is

amending RI application and renewal

requirements to enable the agency to

deny applications for registration from

entities that have been convicted of a

crime related to the importation,

purchase, or sale of a motor vehicle or

motor vehicle equipment and to revoke

existing registrations held by such

entities. Another amendment will

require an RI to certify that it destroyed

or exported nonconforming motor

vehicle equipment removed from a

vehicle during conformance

modifications. The agency is also

establishing new requirements for motor

vehicles imported under import

eligibility petitions, adopting a clearer

definition of the term ‘‘model year’’ for

import eligibility purposes, and

requiring that import eligibility

petitions include the type classification

and gross vehicle weight rating

(‘‘GVWR’’) of the subject vehicle. This

notice also adopts several amendments

to the RI regulations that add citations

to provisions that can be used as a basis

for the non-automatic suspension of an

RI registration, deletes redundant text

from another provision, and revises

several sections to include the agency’s

current mailing address.

The National Traffic and Motor

Vehicle Safety Act of 1966 as amended

(‘‘the Safety Act’’), now codified at 49

U.S.C. chapter 301, requires imported

vehicles to meet Federal motor vehicle

safety standards (‘‘FMVSS’’). Effective

January 10, 1968, a regulation jointly

issued by NHTSA and the United States

Customs Service (‘‘Customs’’), 19 CFR

12.80, allowed permanent importation

of motor vehicles not originally

manufactured to meet applicable

FMVSS if, within 120 days from the

date of entry, the importer demonstrated

that the vehicle had been brought into

compliance with those standards.

The Imported Vehicle Safety

Compliance Act of 1988 (Pub. L. 100–

562, ‘‘the 1988 Act’’), which became

effective on January 31, 1990, limited

the importation of vehicles that did not

comply with the FMVSS to those

capable of being modified to comply. To

enhance oversight, the 1988 Act

required that necessary modifications be

performed by ‘‘registered importers’’

(‘‘RIs’’). RIs are business entities that

have demonstrated to NHTSA that they

are technically and financially capable

of importing nonconforming motor

vehicles and of performing the

necessary modifications on those

vehicles so that they conform to all

3. Automobile manufacturers, including Mercedes Benz, General Motors, Toyota,

Volkswagen, Audi, and Porsche, have long-standing contractual agreements with their dealerships

that new automobiles made for sale inside the United States may not be sold to individuals or

companies intending to export the new automobiles outside the United States

4. Automobile manufacturers impose this prohibition on not exporting new automobiles

because unauthorized exports of their new automobiles cause numerous financial problems to the

manufacturers by creating problems in the manufacturers’ distribution markets, causing market

infringement problems, harming franchise dealerships, and causing problems relating to vehicle

recall registration and service.

5. The contractual agreements between automobile manufacturers and dealerships carry

monetary penalties, commonly called “charge backs,” which automobile manufacturers may assess

against dealerships if the manufacturers determine that dealerships are selling new automobiles to

purchasers who intend to export them rather than use them in the United States.

6. In order to determine whether new automobiles are being exported in violation of

these contractual agreements, automobile manufacturers monitor export documents and records at

ports throughout the United States. Automobile manufacturers hire a company, PIERS, a division

of UBM Global Trade, Inc., to collect such documents and records, in part so that the manufacturers

can determine whether new automobiles are being exported in violation of their agreements with

dealerships not to do so.

7. Automobile manufacturers have assessed monetary and other penalties against

automobile dealerships, including those listed above in paragraph 3, when the manufacturers

determine that the dealerships have sold new automobiles which were exported directly from the

United States.

8. Many dealerships, in order to avoid penalties under their contractual agreements with

manufacturers not to sell new automobiles which will be exported, take additional steps in dealing

with customers to obtain assurances from customers that the customers are not going to export the

new automobiles. These additional steps sometimes require that purchasers of automobiles sign

statements, commonly called “do not export agreements,” that they do not intend to export the new

automobiles after purchasing them.

Gas Guzzler Tax: On March 19, 2007 the Canadian Federal government introduced a new excise tax on fuel-inefficient vehicles. This applies to all new vehicles purchased in Canada or imported from the US. Automobiles that have a weighted average fuel consumption rating of 13 or more litres per 100 kilometres will be subject to the excise tax at the following rates:

at least 13 but less than 14 litres per 100 kilometres, $1,000;
at least 14 but less than 15 litres per 100 kilometres, $2,000;
at least 15 but less than 16 litres per 100 kilometres, $3,000; and
16 or more litres per 100 kilometres, $4,000.

Europe Passes New Regulation on IVA System

The European Commission approved a regulation to amend the IVA system, which governs importation of vehicles imported into the European Union from the United States, Canada, Mexico and other countries (originally built to non-EU specifications). The regulation was adopted on February 22, 2011 and will enter into force on February 26, 2012. The regulation will be binding on imports into all EU member states.

Canada has passed legislation to allow vehicle imports from Mexico. Bill S-5, An Act to amend the Motor Vehicle Safety Act and the Canadian Environmental Protection Act, 1999, received Royal Assent on March 23, 2011. With the Canadian government moving towards an election and a halt to all new legislation, this Bill managed to get through the system.

The Bill is part of Canada's obligation to put the North American Free Trade Agreement (NAFTA) into practice. Canada has a system to administer importation of vehicles from the United States, which was introduced after the two countries entered into their own free trade agreement more than two decades ago. When Mexico joined the agreement and NAFTA came into being, Canada had to pass additional legislation to allow imports from Mexico. This law has now been passed. The details still have to be worked out and it will be several years before vehicles can actually come into Canada from Mexico, but at least the governing legislation is now in place. The legislation will become effective when regulations are passed by government. The legislation will phase in imports from Mexico, first allowing older vehicles and then gradually allowing newer vehicles over the next decade.

Before you import a vehicle from the United States, you should understand each step of the importing process, including:

Vehicle admissibility

Determine if the vehicle you would like to purchase can be imported into Canada.

Vehicle branding history

A brand is a record of a prior accident serious enough to result in an insurance write-off (salvage) or even non-repairable status. A brand remains part of the vehicle’s permanent history and may affect the ability to license the vehicle in Canada. The Registrar of Imported Vehicles (RIV) makes U.S. brands available to Canadian provinces and territories. You are strongly advised to verify the vehicle’s branding history through available commercial VIN search engines before you purchase any vehicle in the U.S. or attempt to import it into Canada.

Modification and inspection requirements

Some vehicles may require modifications in order to comply with Transport Canada Motor Vehicle Safety Standards. Determine what modifications your vehicle may require before you import it.

Importing a vehicle

If you are thinking about importing a vehicle from the United States, you should understand the following three main steps of the process:

1. Before you import

Before purchasing and importing a vehicle, find out about the Registrar of Imported Vehicles (RIV) program, vehicle admissibility, RIV exemptions, recall clearance documentation, vehicle modification requirements and vehicle branding history.

2. At the border

Understand your obligations for reporting to U.S. Customs, Canada Border Services Agency (CBSA) and registration into the RIV program.

3. After vehicle entry

Q. 1. How does Customs define a starter-kit?
A. The Canada Border Services Agency (Customs) officers will define a starter kit as parts if it contains only a bare frame and a body shell, with no mechanical parts. If CBSA officers see mechanical parts, they will ask Transport Canada to decide if the kit is a car or parts, and if it can enter Canada.
Q. 2. Why did Transport Canada develop a system for importing parts for hobby built cars?
A. The main reason was to help Canadians who build their own cars as a hobby. Since1995, Transport Canada allows them to import a shipment of parts that does not fall under the Motor Vehicle Safety Act. They can then get the rest of the materials needed to complete the car, from Canadian sources. The finished car will fall under provincial laws.
Q. 3. Who decides what parts can be imported?
A. The system was developed over time, with input from enforcement officers, standards developers, engineers, legal counsels, the kit car industry, specialty vehicle associations, etc. A regulations enforcement officer decides, on a case-by-case basis, using the Motor Vehicle Safety Act as a guide.
Q. 4. If cars are regulated and parts are not, why must TC monitor kit imports?
A. Over the years, Transport Canada's Road Safety Directorate has become aware that there is a real difference between:

Importing a kit car that requires only some assembly and maybe adding a power train and some easy to attach parts, and
Importing some body parts, to build a homemade car.

This is why Transport Canada, together with Canada Border Services Agency (Customs), developed a system for importing parts for hobby builders. The system draws the line between a car and a parts shipment.
Q. 5. How fair is the system that decides if a kit shipment is a car or parts?
A. Building a homemade car usually requires a starter kit, which includes a detached body and frame. It may also include some parts that are unique to the body's vintage look. Since not all starter kits are the same, the system sets the criteria as standard as possible, while flexible enough to allow hobby builders to be original and creative.
Q. 6. Why not have a simple rule, like 51% hobby builder supplied parts and 49% kit manufacturer supplied parts?
A. Transport Canada's Road Safety Directorate decided that there are too many variables in determining the percentage of fabrication, such as weight of parts, number of parts, cost of parts, labour hours, etc.
Q. 7. Isn't it safer to have more parts in the kit that specifically fit the kit?
A. Yes. That is why a full kit fits the definition of a passenger class vehicle and must be designed and engineered to meet Canadian Motor Vehicle Safety Standards.
Q. 8. How can Canadian companies sell kit cars in Canada?
A. Many companies that make kit cars or reproduction cars in Canada sell them outside of Canada. They also avoid Canada's Motor Vehicle Safety Act by selling these cars or kits without a national safety mark, within provincial boundaries, where Transport Canada does not have jurisdiction.
Q. 9. How can a reproduction car which represents a vintage car be certified to modern safety standards?
A. Applying federal standards to a kit car will not necessarily change its authentic appearance or its performance. A company's ability to certify its kits depends on its technical and engineering expertise, which can also result in a better, safer, product for hobby builders.
Q. 10. Kit car companies claim to have engineers on staff. Doesn't that mean the vehicles are safe?
A. No. Transport Canada knows that the kit car industry in North America often does not comply with the law or best engineering practices.
Q. 11. The system requires a car kit (starter kit) hobbyist to get parts to complete the car in Canada. Is it legal to buy parts in Canada that have been imported, such as parts from a dealer's parts counter?
A. A hobby builder may NOT import, or have a third party import the parts needed to complete the car. These parts must be bought from a source in Canada not linked to the kit manufacturer.
Q. 12. Why are kit cars freely sold in the United States?
A. People and companies find "loopholes" in American law, and sell uncertified cars. However, anyone who installs the power train in an uncertified kit car in the United States can be charged with breaking the law. To learn more, please contact the National Highway Traffic Safety Administration in Washington, DC.
Q. 13. What if certain parts of the "prohibited" systems cannot be sourced in Canada, but are absolutely essential to the uniqueness of the kit?
A. Transport Canada believes that if a kit is really designed, and is actually being used, as a starter kit to amateur build a car in Canada, such parts would not be absolutely essential.
However, some kits are very basic. They may only contain a bare body shell with a windshield, some door hinges and latches, and a bare frame. In these very basic kits that are far from the definition of "vehicle" there may sometimes be room for such items as a particular suspension piece or a fuel cell.
Q. 14. What can a hobby builder do when parts that can be sourced only from the kit manufacturer are missing from the shipment?
A. Contact Transport Canada's (TC) Road Safety Directorate. Getting a second shipment of a missing part is not the same thing as illegally bringing in extra parts that were not on the original list reviewed by TC.
Q. 15. What can happen to someone who imports more parts in addition to a kit list that has already cleared Customs?
A. This is against the law. To learn about penalties, see "offences and punishments" in section 17 of the Motor Vehicle Safety Act.
Q. 16. May a kit made up of a frame with steering system, fuel cells, brake system, some wiring, suspension system including hubs, and a steering column with a key lock system, but without the body, be imported as parts?
A. No, not likely. Most kits are designed to accommodate a particular body, body parts and power train. Such a kit would be considered to be a "vehicle" as defined in the Canada Motor Vehicle Safety Act. It would have to be certified.
Q. 17. Is it possible under the present system to import kits on a commercial level to sell them in Canada?
A. No. The current system exists solely to help hobby builders to build their own car at home, not to provide a business opportunity.
Q. 18. Can a kit be imported or sold in Canada where the body and frame are assembled at the factory by brazing, welding or riveting?
A. If permanently attached body panels are part of the load bearing structure together with the frame members, and the body is shipped with seats, interior, lamps or wiring harness, not installed, and without the systems mentioned earlier in these guidelines, Customs will most likely clear the shipment as a parts.
Q. 19. Does TC recognize any of the SVA testing conducted by the UK Department of Transport for these kit vehicles?
A. If a replicar or a kit car complies with only those Canadian Motor Vehicle Safety Standards (CMVSS) listed in the Single Vehicle Approval Testing (SVA) manual, it CANNOT be imported into Canada, unless:

the vehicle also complies with those CMVSS that are not listed in the SVA;
the manufacturer certifies the vehicle to all Canadian federal standards that apply; and
the manufacturer has all the required test records to demonstrate compliance.

If the kit is considered a parts shipment, it is not required to meet the SVA or the CMVSS.
Q 20. Why do kit cars generally NOT clear Customs?
A. Transport Canada knows that the kit car industry does not comply with North American federal safety standards. For example, according to the United States National Highway Traffic Safety Administration, there are over 200 kit car manufacturers in North America, and not one complies with federal standards.

Are you a hobby builder who plans to:

manufacture kit cars or reproduction vehicles in Canada for the purpose of sale;
import kit cars or reproduction vehicles into Canada;
amateur build a kit car in Canada using an imported starter kit; or
amateur build a kit car in Canada using a Canadian starter kit?

If you are, it is important that you know and obey Canada's Motor Vehicle Safety Act (the Act).
The Act requires that vehicles made in Canada for the purpose of interprovincial sale, or imported into Canada, be certified to federal safety standards by their original manufacturer. Since most kit cars meet Transport Canada's definition of a "passenger car", they must meet the safety standards for that class.

Manufacturing kit cars in Canada

Manufacturers must design, build, test and certify their products to meet all Canadian Motor Vehicle Safety Standards (CMVSS), according to approved test methods and keep records of the results.
Before starting a vehicle manufacturing business in Canada, you must show Transport Canada's Road Safety Directorate that your prototype vehicles, as tested, meet all federal safety standards (Section 5(1)(g) of the Act). Section 5 of the Act applies whether the vehicles are shipped already assembled or in pieces for the buyer to assemble.
You must prove that you followed approved test methods and place all required information on the vehicle. When satisfied, Transport Canada (TC) will give you authority to place the national safety mark on your products.

Importing kit cars into Canada

If you want to import a kit car or a reproduction vehicle that can be driven, you must provide proof that it meets all passenger car class CMVSS before importing it. There is no difference, under the Act, between assembled and disassembled vehicles. Note: Most kit cars do NOT qualify. Therefore, kit cars cannot be manufactured to sell in Canada or imported into Canada.

Amateur building of kit cars from imported starter kits

Is a starter kit a car or parts? Shipment contents provide useful clues, and each import is considered on its own merits. TC may ask for a complete parts list (not including attachment hardware).
In a parts shipment/starter kit, important systems such as the fuel system, the brake system, the power train and the suspension system are not included.
When these systems are completely absent, the kit will likely pass Customs if:

the kit is not assembled (the body and frame are separate);
the wiring harness, steering system and interior parts are not installed (with the possible exception of the windshield, some trim and the instrument panel).

Importing a starter kit

TC suggests that you research and visit the company that is manufacturing your kit and make sure that the kit will clear Customs before you make any payments.
If you plan to build your own car using an imported starter kit, you can make clearing Customs easier if you:

Have the manufacturer fax send you an exact packing list of the parts that will be in the container when it reaches Canada Border Services Agency (CBSA) and fax it to TC before you buy the kit.
Make sure the list:
- has a number on each page that will correspond with the import documents;
- has the manufacturer's name in the letterhead; and
- exactly matches the packing list supplied with the shipment and the parts that will be in it.
Since you are importing parts only, you will need a detailed list of every part, as you would get from any parts counter, including part numbers (except nuts, bolts, washers, clips, fasteners, etc., which can be listed together). TC will not accept a list of parts that are deleted from a kit.

Note: Importing a kit from a private sale can pose a problem, but TC will review the parts list without part numbers and determine each case on its own merits.
Fill out and sign the declaration form you will find at the end of this document and fax it and the parts list to 613-998-8541.

If TC considers that the parts on the list do NOT add up to a motor vehicle that can be certified, you will receive a form letter to present to CBSA. The letter will state that the shipment is admissible as "parts only" and that no other shipments may follow.

Amateur building kit car from Canadian starter kits

It is likely against the law for a Canadian kit car manufacturer to sell kits with too many parts, such as the important systems listed earlier.

Important Notes:

It is against the law (sections 5 (1) and 6 of the Act) to import a vehicle or sell a new vehicle in Canada that does not meet CMVSS. Importing such a vehicle in different shipments is a violation punishable under section 17 of the Act.
